A homebuyer in Delhi NCR has been awarded a compensation of Rs 65 lakh by the Haryana Real Estate Regulatory Authority (HRERA) for an inordinate delay of over nine years in getting possession of a flat in Gurgaon. The case highlights the growing impact of regulatory bodies like HRERA in protecting the interests of homebuyers facing delays from builders and real estate developers.
The buyer had booked the flat in a residential project located in Sector 70A of Gurgaon, with the possession promised within 36 months. However, the developer failed to deliver the unit even after almost a decade, causing financial and emotional distress to the buyer. After several follow-ups and no satisfactory resolution, the buyer approached HRERA seeking justice.
HRERA reviewed the case and ruled in favor of the buyer, ordering the developer to pay a compensation of Rs 65 lakh for the prolonged delay. The compensation was calculated based on interest on the amount paid by the buyer, acknowledging the mental agony and financial burden caused by the delay.
This ruling reinforces the accountability of builders under the Real Estate (Regulation and Development) Act, 2016. It also serves as a warning to developers across Delhi NCR and other parts of India to adhere strictly to possession timelines. Delays without justifiable reasons can lead to hefty penalties and loss of reputation in the real estate market.
