GREATER NOIDA: In cases where promoters are delaying handing over flats to homebuyers, the Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) will pull a developer's property and appoint a receiver to complete unit registration. If the authority's orders are not followed, the penalty will be increased.
This activity had been decided in line with the legal provisions set forward in Section-40(2) of the RERA Act, 2016 and Rule-24 of the UP.
"If instructions for property and registration are required, we will connect the investment homes and assign an audience to bring out the registration form and give time buyers ownership."
Applying the law officers in the NCR and Lucknow offices who have previously served as district judges will be started referring to and authorized to take the above action," said Rajive Kumar, chairman of UP-RERA.
According to officials, the move will add pressure on development companies who are going to delay the registration and not try to hand over flats to buyers even after the construction was completed. "In cases where the promoter has finished construction but is delaying the procedure of ownership and registry to convert property title, we will intervene." "The appointed listener will pave the legitimate route for the handover of flats and the execution of registries in finished products," Kumar added.
According to officials, at least 2586 applications have been filed by homebuyers for noncompliance with UP-RERA orders. After making orders to the builder and complainant, the regulator will take only 15 days to begin the process and resolve a non-compliance issue.
"If it goes well, this is a positive step." "There are lots of cases in which UP-RERA commands will not be applied, and buyers have not received justice," said homebuyer Ashish Mohan Gupta.
The UP-RERA is a government expert body on the reality that was established in 2016. Order 21 of the Rules Of Court grants it quasi-judicial abilities to effectively carry out its orders.
