The Telangana Real Estate Regulatory Authority (TGRERA) has imposed a penalty of ₹4.27 lakh on Hyderabad-based Sanali Housing Projects Ltd for advertising a residential project before obtaining the necessary registration. The builder promoted its upcoming project, "Sanali Pinnacle," located at Aziz Bagh Colony in Shaikpet, through its website and an on-site display board, which was deemed a violation .
A three-member RERA panel, comprising Chairperson Dr. N Satyanarayana and members K Srinivas Rao and Laxmi Narayana Jannu, delivered the judgment against the company’s directors—Ali Mohammed Haq, Amir Mohammed Haq, and Noor Haq. The panel ruled that by marketing the project without prior registration, the builder had violated TGRERA regulations. According to Section 2(b) of the Act, any form of promotion before registration is considered an advertisement, making the company's actions unlawful.
Sanali Housing Projects Ltd had positioned "Sanali Pinnacle" as an "ultra-luxurious apartment complex" with 40 exclusive units, openly displaying a promotional board describing it as an “exquisitely crafted residence.” However, without TGRERA approval, such promotional activities are not permitted. The authority has directed the builder to pay the fine within 60 days and immediately register the project with RERA. Until the registration process is complete, the company has been barred from any form of advertising, marketing, booking, or selling units in the project.
This ruling reinforces the importance of compliance with real estate regulations to protect homebuyers from misleading promotions and ensure transparency in property transactions. Developers are required to follow RERA guidelines strictly before launching or marketing any real estate projects.
