For the unilateral cancellation of a sale agreement involving Flat No. 801 in the Ayyanna Prima project at Guttala Begumpet, Serilingampally, the Telangana Real Estate Regulatory Authority (TGRERA) has issued an interim order against Ayyanna Infra Pvt Ltd, a builder based in Hyderabad. Following homeowner Adi Vanaja's complaint, the Authority determined that the builder's explanation for the cancellation—alleged non-compliance with the payment schedule—was inadequate and did not adhere to legal procedures.

Vanaja claimed to have paid Rs 3.45 crore for the flat, including three parking spaces and an undivided land share of 105 square yards. She provided two sale agreements dated January 30, 2021, as evidence. However, the builder cancelled the agreement via an email dated September 14, 2023, sent to her husband's email, without initiating any refund or properly invoking the forfeiture clause. The Authority noted that this mode of communication and the lack of direct correspondence with the buyer rendered the cancellation legally invalid.

Upon examining the agreements, TGRERA found no clause specifying a proper termination process and concluded that the agreement continues to be legally binding. It held that allowing any third-party interest in the disputed flat could severely prejudice the complainant’s rights. 
The ruling panel, comprising Chairperson Dr. N Satyanarayana and members K. Srinivasa Rao and Laxmi Narayana Jannu, emphasized that interim protection of the buyer’s rights is necessary until final adjudication. The builder has been explicitly restrained from selling, mortgaging, or transferring the property in any way, ensuring that no further complications arise while the dispute is pending resolution. This order reinforces regulatory oversight on arbitrary developer actions in Hyderabad’s real estate sector.
