The Telangana State Real Estate Regulatory Authority (TGRERA) has imposed a penalty of ₹13,74,436 on a Hyderabad builder for violating the Real Estate (Regulation and Development) Act, 2016. The builder was penalized for using an improper Agreement of Sale and failing to register the agreement while selling an apartment.
The three-member TGRERA panel, led by Chairman Dr. N Satyanarayana along with members K Srinivasa Rao and Laxmi Narayana Jannu, delivered the order in Complaint No. 158 of 2024. The complaint was filed by Veluri Adi Lakshmi against builder Vineela Arani, who was constructing a stilt plus five-floor building at Park Avenue in Kondapur, Serilingampally mandal.
The complainant had planned to purchase a flat on the fifth floor for ₹1,14,32,000 and had paid ₹63,45,000 in installments. She alleged that the builder refused to register the apartment and was demanding additional money due to price escalation. Later, she withdrew from the project, and the builder refunded the amount except for ₹95,000, which was retained as a ‘booking amount.’ TGRERA ruled that the complainant was not entitled to this amount since the cancellation was made at her request.
The penalties were imposed under Section 13 read with Section 61 and Section 4 read with Section 60 of the Act. The violations included the builder using an Agreement of Sale that differed from the draft submitted to RERA under Rule 38 and failing to register the Agreement of Sale executed on January 25, 2024.
The builder has been directed to pay the penalty within 30 days to the RERA fund. Additionally, the authority ordered strict compliance with the registered Agreement of Sale and warned of further penalties under Section 63 for any future violations.
