On Tuesday, the Orissa High Court was informed that a new Odisha Apartment Ownership Management Bill is being drafted by the State government. PIL challenging the validity of the Odisha Apartment Ownership (Amendment) Rules 2021 was being heard in court. 

An apartment owner from Bhubaneswar filed the petition, alleging that the Odisha Apartment Ownership (Amendment) Rules 2021 violate the Real Estate (Regulation and Development) - RERA Act, 2016.

The government presented a revised flat booking agreement and informed of the Odisha Real Estate (Regulation and Development) Amendment Rules 2022 that were notified by the Urban Development and Housing department on September 12.

According to the division bench comprising Chief Justice S Muralidhar and Justice Chittaranjan Dash, "Any ad hoc temporary solution to the problems faced by the apartment owners will only compound their problems."

Government officials were instructed by the court to draft a rule compliant with RERA, which mandates the transfer of common areas to apartment owner's associations.
